Terms of Use

Each course is available for 28 days from the date of enrolment, on phone, tablet or computer, at any time. Access starts the moment your enrolment is confirmed. After 28 days your access to that course ends.

If you need more time, ask before your access ends. We, or the school that enrolled you, may extend or reset your access at our discretion, up to 90 days from your original enrolment date. Extra time does not extend the Pass Guarantee on its own: see condition 7 in section 5.

Within the first 15 days of a course, and before you have completed 30% of it, you may ask once to switch to a different course. After that, a different course is a new enrolment.

Courses are paid for online through our payment providers, PayFast and PayPal. The price shown at checkout, in South African Rand, is the price you pay. Prices may change, and a change does not affect a course already paid for. Discount codes and vouchers from partner schools are tied to the course they are issued for, and single-use codes work once.

Access begins immediately on payment and the full course is available to you at once. You agree that the service starts straight away, and that the seven-day cooling-off right in section 44 of the Electronic Communications and Transactions Act therefore does not apply.

Except under the Pass Guarantee, or where the law requires it, fees are not refundable once access has been granted. A payment reversed through your bank or card provider while the course is in use ends your access.

We offer a Pass Guarantee to students who follow the Programme as set out here and still fail the official K53 learner’s licence test: the course fee is refunded in full. The platform records every slide opened, how much of each narration is heard, every test attempt and the time between attempts, every login, and any extra days granted. A claim is assessed against that record. The guarantee holds only when every condition below is met.

1. Listen to every slide to the end. Skipping ahead, muting, or clicking past a slide before the narration finishes is recorded. A module done that way counts as skipped.
2. Pass every module test at 100% before sitting the final exam. Retaking a passed test for revision is unlimited and never counts against you.
3. Revise before you retake. A failed module test must be followed by that module’s slides before the next attempt. A test retaken without a slide reopened in between is recorded.
4. Pass the final exam at 100% twice, on two different days.
5. Finish the course inside its 28 days of access, or inside an extension granted before access ended.
6. Write the official test within 10 days of completing the course. If the test is later than that, every module must be reopened and revised within the 10 days before the test date.
7. Use any extra time granted. An extension keeps the guarantee only if it is used: log in, finish inside the extended time, and meet condition 6. Extra days granted and not used cancel the guarantee.

One learner, one profile: the answers on an account must be the account holder’s own. A shared account has no guarantee.

To claim, submit the written result issued by the test centre and your booking receipt at www.onlinek53.co.za/guarantee/claim within 14 days of the test date. A claim cannot be assessed without the result paper.

We decide a claim from the platform’s record and tell you the outcome and the reasons. A successful claim is refunded within 14 days of the decision, to the payment method used, for the amount actually paid for that course. A course paid for by a school is refunded to the school. One claim per enrolment. A claim supported by a falsified result paper or receipt is declined and the account closed.

If you joined through a partner driving school or a school’s code, that school can see your progress, results, reports and contact details for the courses you took with it, and may extend or reset your access.

A parent or guardian may be linked to your account by your school or by us. A linked parent sees your progress and reports but cannot change anything or do any part of the course for you. If you are 18 or older and do not want a linked parent to see your progress, tell us and we will remove the link.

All videos, audio, images, narration, quizzes, questions, reports and other course materials are owned by us or our licensors and are protected by copyright under the Copyright Act. They are licensed to you for your personal study only, on your own account, for the period of your access. You may not copy, record, screenshot, download, share, redistribute, teach from or resell any part of the Programme, and every slide carries the name of the account it was shown to.

“Online K53 University”, our logo and the look of the Programme are our trade marks and trade dress. You may not use them, or anything confusingly similar, in the name of a business, a website, a social media account or advertising without our written permission. Partner schools may say that they use the Programme and may use the affiliate badge we give them, and nothing more.

Anything you post in the discussion area, or upload with a guarantee claim, stays yours. By posting or uploading it you give us a licence to store, display and use it to run the Programme and to assess claims. Do not post anything unlawful, abusive, or copied from someone else, and do not post the questions or answers from any test. We may remove a post at our discretion.

If you believe material on the Programme infringes your rights, or you find our material copied elsewhere, email info@onlinek53.co.za with the details and we will act on it.

We aim to keep the Programme available at all times but cannot promise uninterrupted access. We may take it offline briefly for maintenance, and we are not liable for interruptions caused by your device, your connection or a third-party service. Your data costs are your own.

The official test, its questions and the rules it examines are set by the authorities and can change. We keep the Programme updated, but we are not responsible for such changes, for test bookings, test dates, or the conduct of any test centre.

To the extent the law allows, our liability to you for anything arising from the Programme is limited to the fee you paid for the course concerned. Nothing in these terms limits the rights you have under the Consumer Protection Act.
